Terms of Service

1. Definitions

• → “Platform” means the AgencySort website at agencysort.com and all associated services
• → “Agency” means a business that registers to create or maintain a listing on AgencySort
• → “Buyer” means a business or individual who uses AgencySort to find an agency or submit a project brief
• → “User” means any person who accesses or uses the Platform
• → “Content” means any text, images, case studies, reviews, or other material submitted to the Platform
• → “Subscription” means a paid plan for premium agency listing features

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organisation you represent. By using the Platform, you confirm that you meet these requirements. AgencySort is intended for business use — by registering as an agency, you confirm that you represent a legitimate, trading business entity.

3. Agency listings

3.1 Application and verification

To create a listing, agencies must submit an application. AgencySort reviews applications manually and may approve or reject any application at our sole discretion. Approval is not guaranteed. We verify that agencies meet our standards before listing, including checks on trading history, client references, and case studies.

3.2 Accuracy of information

You are responsible for ensuring that all information in your listing is accurate, up to date, and not misleading. This includes service descriptions, case studies, team size, awards, and any other claims. AgencySort reserves the right to remove or edit content that we reasonably believe to be inaccurate or misleading.

3.3 Prohibited content

You must not submit content that is false, defamatory, harassing, illegal, or that infringes third-party intellectual property rights. You must not impersonate another agency or business. Case studies must relate to genuine work you have performed for real clients.

4. Subscriptions and payments

4.1 Free listings

A verified free listing provides basic placement in the AgencySort directory with no charge. Free listings are subject to these Terms and may be removed if you no longer meet our verification standards.

4.2 Premium subscriptions

Premium subscriptions provide enhanced features including featured placement, analytics, and access to project briefs. Subscriptions are billed monthly or annually in advance. Prices are as displayed on our pricing page at the time of purchase.

4.3 Cancellation and refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to premium features until then. We do not offer refunds for partial billing periods unless required by law. For annual subscriptions cancelled within 14 days of purchase, we will provide a full refund if no premium features have been used.

4.4 Price changes

We may change subscription prices with at least 30 days' notice. Price changes will not affect your current subscription period — new pricing applies from the next renewal date.

5. Project briefs

Buyers may submit project briefs free of charge. By submitting a brief, you consent to your contact details and project information being shared with matched agencies for the purpose of responding to your enquiry. AgencySort does not guarantee that any agency will respond to your brief or that any resulting engagement will be successful.

AgencySort is not a party to any contract entered into between a buyer and an agency. Any disputes arising from engagements are between the buyer and agency directly.

6. Reviews

Reviews must be honest, accurate, and based on a genuine working relationship with the agency in question. You must not submit fake, incentivised, or defamatory reviews. AgencySort verifies reviews through email confirmation and reserves the right to remove any review that appears to violate these principles.

Agencies must not solicit fake reviews, offer incentives for reviews, or attempt to manipulate their review score in any way. Violations may result in listing removal.

7. Intellectual property

AgencySort owns all intellectual property rights in the Platform, including its design, features, and original content. You retain ownership of the content you submit (case studies, descriptions, logos). By submitting content, you grant AgencySort a non-exclusive, worldwide, royalty-free licence to display and promote that content on the Platform and in marketing materials.

You must not copy, scrape, or reproduce AgencySort content without our written permission. Automated scraping of the Platform is strictly prohibited.

8. Termination

You may close your account at any time by contacting us at hello@agencysort.com.

AgencySort may suspend or terminate your listing or account if you breach these Terms, if we determine that your listing no longer meets our verification standards, or if we reasonably believe continued listing poses a risk to buyers or the integrity of the platform. We will endeavour to give notice before termination except where immediate action is necessary. Active subscriptions will be cancelled and a pro-rata refund provided on termination by us without cause.

9. Disclaimers

AgencySort provides a directory and matching platform. We do not endorse, warrant, or guarantee the quality, suitability, or performance of any listed agency. Agency listings are based on the information provided by agencies and our verification checks, which do not constitute a comprehensive due diligence review.

The Platform is provided “as is” and “as available”. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of liability

To the maximum extent permitted by law, AgencySort shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including lost profits, lost data, or business interruption.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to AgencySort in the 12 months preceding the claim, or £100, whichever is greater. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 14 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. The “last updated” date at the top of this page reflects the most recent revision.
